Welcome to Culture Shrooms — Once Upon a Shroom. We built this space to help you explore functional mushrooms and legal psychoactives with real information and real care. Before you shop with us online or visit our store, please take a few minutes to read the terms below. They explain what to expect from us, what we expect from you, and how we handle things like age verification, shipping, and returns.
Part A — Terms of Service
1. Acceptance of Terms
This website is operated by Culture Shrooms, a brand of 02 Solutions LLC (“Culture Shrooms,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of cultureshrooms.com (the “Site”), our retail location in the East Village Arts District of Long Beach, CA, and any products, services, classes, or events we offer (collectively, the “Services”).
By accessing the Site, placing an order, visiting our store, or attending one of our events, you agree to be bound by these Terms and our Privacy Policy below. If you do not agree, please do not use the Site or our Services.
We may update these Terms at any time by posting a revised version on this page with a new “Last Updated” date. Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to check back periodically.
2. Eligibility & Age Requirement
You must be at least 18 years old to purchase any product from Culture Shrooms — online or in-store — and to attend any in-store event. By placing an order or entering our store, you represent and warrant that you are 18 years of age or older. We reserve the right to request valid, government-issued photo ID to verify age before completing a sale or admitting you to an event, and to refuse service to anyone unable to provide it.
We do not knowingly sell to, market to, or collect information from anyone under 18. If we learn that someone under 18 has placed an order or provided us personal information, we will cancel the order and delete the information as soon as reasonably possible.
3. Our Products — Please Read Carefully
Culture Shrooms sells functional and medicinal mushroom products (tinctures, capsules, coffees, teas, powders) as well as legal psychoactive products, in various forms. A few important things to know:
- These statements have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical advice, diagnosis, or treatment.
- Always consult your physician or another qualified healthcare provider before using any of our products — especially if you are pregnant, nursing, taking prescription medication, have a medical condition, or have a history of mental health conditions.
- Do not combine our products with alcohol or other substances unless you have discussed this with a healthcare provider.
- Keep all products out of reach of children and pets.
- Everybody responds differently. Start low, go slow, and never operate a vehicle or heavy machinery after using a psychoactive product.
- Product descriptions and educational content on this Site and in our store are for general informational purposes only, reflect our own research and experience, and are not medical claims.
4. Legal Compliance & Shipping Restrictions
The legal status of mushroom-derived and psychoactive products varies by state and can change. It is your responsibility to know and follow the laws of your own state, county, and city before ordering.
By placing an order, you represent that the products you're purchasing are legal to possess and use where you live. We reserve the right to refuse, cancel, or delay any order we reasonably believe may violate the law at the destination, without liability to us beyond refunding the purchase price of the cancelled items.
We do not knowingly ship certain products to jurisdictions where they are restricted or banned (for example, Amanita muscaria products currently cannot be shipped to Louisiana). This list changes as laws change — if you're unsure whether a product is legal where you live, contact us at info@cultureshrooms.com before ordering, and check your own state's current regulations.
5. Orders, Pricing & Payment
We accept Visa, Mastercard, American Express, Discover, and PayPal. All prices are listed in U.S. Dollars and are subject to change without notice. We make every reasonable effort to display accurate pricing and product information, but errors can happen — if we discover a pricing or listing error on an order you've placed, we will contact you before charging or shipping, and you may cancel the order if you don't wish to proceed at the corrected price.
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized or unlawful activity, or pricing/listing errors. If your order is cancelled after payment, you will be refunded in full.
To help prevent fraud and underage purchases, we may request additional verification before an order ships, which may include a copy of the cardholder's ID and/or the card used for the purchase. This is used solely for verification and is not shared with third parties beyond what's needed to complete that verification.
6. Shipping & Delivery
Once a package leaves our hands and is scanned by the carrier, it is out of our control. Culture Shrooms is not responsible for packages that are lost, delayed, or stolen after being marked as delivered by the carrier. If your package is lost or stolen in transit, we're happy to help you file a claim with the carrier, and where reasonably possible we'll work with you toward a resolution — but we cannot guarantee a refund or replacement for carrier-related loss or theft.
Shipping times are estimates, not guarantees. We are not responsible for delays caused by the carrier, weather, customs, or other events outside our control.
7. Returns & Refunds
Because our products are consumable and their safety and integrity can't be guaranteed once they've left our facility, all sales are final. We do not offer refunds or exchanges for change of mind. This policy is posted at checkout and at our point of sale in-store, as required under California law for retailers with a no-refund policy.
The one exception: if you receive a defective product or the wrong item, email info@cultureshrooms.com within 7 days of delivery with your order number and a photo of the issue, and we will replace it or issue store credit at our discretion, at no cost to you.
8. In-Store Visits, Grow Room & Events
Our Long Beach shop includes seating, games, and a grow room featuring grow kits for guests to view and enjoy. By visiting, you agree to treat our space, staff, and fellow guests with respect, and to follow any posted store rules.
We also host small crafting events (15 guests or fewer). Some events may involve tools, heat, or other materials — if you attend one of our events, you agree to follow staff instructions and take responsibility for your own safety and any items you create. Additional waivers may apply for specific events and will be provided at the time of registration.
9. Intellectual Property
All content on this Site — including text, graphics, logos, product photography, the Culture Shrooms name, “Once Upon a Shroom,” and other trademarks — is the property of Culture Shrooms / 02 Solutions LLC or our licensors and is protected by copyright and trademark law. You may view and use this Site to place an order or for personal, non-commercial reference. You may not copy, reproduce, republish, modify, or distribute any content from this Site without our prior written permission.
10. Prohibited Uses
You agree not to use the Site or Services to: violate any applicable law or regulation; infringe our or anyone else's intellectual property, privacy, or other rights; transmit anything that threatens, harasses, or defames another person or business; attempt to gain unauthorized access to our systems; or interfere with the security or proper functioning of the Site.
11. Disclaimer of Warranties
The Site and our products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot be excluded by law. We do not guarantee that the Site will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Culture Shrooms and 02 Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or our products. Our total liability to you for any claim arising from your order will not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms limits any liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or violations of consumer protection laws that can't be waived.
13. Indemnification
You agree to indemnify and hold harmless Culture Shrooms, 02 Solutions LLC, and our owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of our products, or violation of any law or third-party right.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction and venue.
15. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. These Terms, together with the Privacy Policy below and any additional policies we reference, make up the entire agreement between you and Culture Shrooms regarding the Site and Services, and supersede any prior agreements.
Part B — Privacy Policy
16. Our Commitment
At Culture Shrooms, we believe protecting your privacy matters as much as protecting your health. This Privacy Policy explains what information we collect, how we use it, and the rights you have over it.
17. What We Collect
When you place an order, register an account, or contact us, we may collect: your full name, email address, phone number, billing and shipping address, payment details (processed securely by our payment processor — we do not store full card numbers), and your order history. If you register without ordering, we collect your name and email address.
18. How We Use It
We use your information only to fulfill and ship your order, communicate with you about your order or account, provide customer support, verify your age and identity where required, and improve our products and Site. We do not sell your personal information to third parties.
19. Cookies
We use cookies and similar technologies to keep your cart working, remember your preferences, and understand how visitors use our Site. You can control cookies through your browser settings; disabling them may affect some Site features.
20. Third-Party Links
Our Site may link to third-party websites. We are not responsible for the content or privacy practices of those sites, and this Privacy Policy applies only to cultureshrooms.com. We recommend reviewing the privacy policy of any third-party site you visit.
21. Security & Fraud Prevention
We use commercially reasonable safeguards to protect your personal information. To prevent fraud and underage purchases, we may request additional verification (such as a copy of ID) before shipping an order; this is used only for verification and is not shared with third parties beyond what's needed for that purpose.
We may disclose personal information when required by law, or where we believe it's necessary to: protect and defend the rights or property of Culture Shrooms; cooperate with a legal investigation (such as suspected credit card fraud or underage purchases); or identify someone who may be violating the law, another person's rights, or misusing our Site.
22. Your California Privacy Rights (CCPA)
If you are a California resident, you have the right to: know what personal information we've collected about you and how it's used; request deletion of your personal information, subject to certain legal exceptions; correct inaccurate personal information; and opt out of the “sale” or “sharing” of your personal information (we do not currently sell or share personal information as defined by the CCPA). We will not discriminate against you for exercising any of these rights. To exercise a right, email info@cultureshrooms.com from the email address associated with your account or order.
23. Children's Privacy
Our Services are not directed to anyone under 21, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal data, please contact us and we will delete it.
